There’s a legal battle out there that has just floored me. I have searched and searched to find the truth, hoping this scenario has more to it than meets the eye, but to no avail. There’s not one article that appears different than the others, the facts appear to be just that and it’s worse than the hot McDonald’s coffee. No, I’m not referring to the Sandusky trial, although I may be discussing that one shortly,no…this one is about the lady who, in my opinion, has lost her mind and is suing a former Little League Baseball Player. Now some of you may say that I’m being harsh and that I wasn’t there to witness the incident so I don’t know exactly what happened, but let’s just pretend I’m Nancy Grace for a minute and therefore, I get to make all the assumptions I want based off the articles I’ve read.
And by the way, the little leaguer was 11 years old when the incident occurred.

She was a spectator sitting at a picnic table near the bullpen where little league catcher Matthew Miggliaccio was warming up a pitcher. Matthew threw the ball back to the pitcher and as 11 years will do, accidentally threw it off and hit Elizabeth Lloyd in the face.
This happens. As a baseball Mom for over ten years now (and not even mentioning my own softball incidents) I can tell you that when you are a spectator at any sport, you assume some risk and it hurts. Just recently I had a baseball size black and blue mark on the side of my leg from getting hit while standing near a bullpen. You know what my thoughts were about this incident?? That’s what I get for standing there. Duh.
But there is no way a child should have to go to court for not being able to control every throw.
She is suing for $150,000 for medical expenses and an undisclosed amount for “pain and suffering”. Wow. Wonder how much Matthew receives in allowances every week.
And here’s the kicker…those two cases are not the only two in this situation, nope…her husband is also suing little Matthew. Yep, he claims loss of “services, society, and consortium” of his wife.
What’s that mean?
Wikipedia has consortium as, “A consortium is an association of two or more individuals, companies, organizations or governments (or any combination of these entities) with the objective of participating in a common activity or pooling their resources for achieving a common goal.”
Soooo? What’s that mean? Matthew ruined the dream that he and he wife would live happily ever after? I don’t understand.
They’ve demanded a jury trial. Really? You can DEMAND a jury trial?? Because honestly, I still would like to plead my case about how Colonel Sanders changed a perfectly fine recipe without telling anyone. I know you did Colonel…admit it or you’re messing with my consortium.
What do ya’ll think about this one? And yes, before any of you say it…we can’t possibly know what happened unless we were there…I know, we’d like to be as fair to the situation as possible, but this is just a little ol’ blog, go ahead and vent!
Has this couple lost their freaking minds??

You get out of bed in the morning, you assume the risk of falling over and breaking your neck. If I do, who can I sue? I hope the judge ruins their ‘consortium’ a little more!

Oh my god!! What a ridiculously pathetic little woman. It’s the same thing you see on out-take programs. What kind of sadistic witch (being polite – substitute for something similar sounding) sues an 11 year old for playing a sport in area where the support is supposed to be played.
My daughter got crapped on by a bird yesterday, should I sue the bird for my washing bill? No judge or jury in their right mind would rule in her favour. I think she should be posted all over the internet and on every street corner as the woman who wants to sue a child for playing ball!!
A little leaguer? And she went there voluntarily? Did she pay to get in? Suing the child is ridiculous. I could see a suit against a professional sports team, but… I was hit by a puck (in the forearm) at a Bruins game, it hurt like hell for a day, it just went with the territory.
Wow, this is disgusting. Now, I have read of people getting killed by hockey pucks–that might be something–but a baseball, sheesh.
Especially little league Susan. I have seen a couple instances where someone has seriously gotten injured (and some died) but that was all at the major league level. Not at all anywhere close to 11 year olds.
“Lost their minds” I’m not going to give them that much credit. It would insinuate they are not responsible for their awful actions. They are greedy criminals manipulating the judicial system to receive money they did not earn. Sadly its the court system that has lost its mind and should have fined the lawyer/s for even taking on this baseless case and taking time away from people who truly need the court’s attention. Now that would be a lesson for all.

In the “Sports Illustrated” article on this case, the father of the little boy says he’s also angry at the Little League organization for not helping them with their defense, since the family will have to hire a lawyer. I hope a smart lawyer volunteers to help the boy for free.
It’s unfortunate that Little League didn’t have insurance to cover spectator injury, then maybe the matter would have been resolved before all this media attention. A $150,000 medical bill for a stray ball thrown at a game is a BIG price to pay to be anywhere within a stray ball’s path. What if this ball had smacked a baby in the head?

Ann Curry is not being fired from co-hosting The Today Show (NBC) because everyone hates her…that’s ridiculous! She is not a good news anchor nor is she a good journalist because she simply doesn’t understand those very complicated topics…like politics, economics, foreign affairs…but she does know how to act sincere…when to lower her voice…and to cast her eyes downward…but that is just acting like she cares. I have had a difficult time following her interviews and taking her seriously. She has to read her notes when questioning in complicated or technical areas. No, you cannot be an expert in all areas or subjects, but a good interviewer knows how to convince others she does know the subject matter. I do believe attorney Savannah Guthrie is very intelligent in these areas and does great interviews…and will be the likely replacement for Ann Curry. Do not bring in some angry anti this or anti that person who believes she is qualified to render her opinion in all matters…I really would turn off Today, for good. Anybody agree with me?
I don’t know much about Ann Curry, but Nancy Grace is one that I get angry if I even catch a few minutes of her show. Between her and what Dr Phil says, I’m pretty sure I could do their shows!

I say we do as a fellow commentator stated, plaster her face and his all over the internet with a brief description of the lawsuit think this would embarrass them enough to drop the malicious persecution of the 11 yr old? Doubt it so maybe putting up fliers or billboard in their neighborhood? Heck I would chip in for that. Some people are born without common~sense others are born without the wiring in the brain connecting properly. These two need to be exposed as two of the many human`beings born without connecting properly AND no common ~sense. Unless
they are those that did a variety of drugs and now have Play~Doh for brains.
LOL, that could very well be the exact reason why they are going through with this….and apparantly, have bothered this child since it happened. The Dad mentioned receiving threatening letters from the lady. When this goes to trail, the judge should reverse the case and arrest her for stalking and threatening a child.
People make me sad. It has come to the point where no one wants to do anything in public with anyone because heaven forbid someone has an ACCIDENT. I know my parents kind of feel that way about their pool. They are afraid to let people come over and enjoy because if a kid dives (even though it says no diving) and breaks something, my parents could get sued. Even friends and family are suing one another. it is sick!
I can completely understand your parents being afraid of a lawsuit! It is sick and such a shame to destroy friendships, relationships, etc on the prefix of gaining a couple dollars.
