When you’re a spectator, you assume some risk!

There’s a legal battle out there that has just floored me.  I have searched and searched to find the truth, hoping this scenario has more to it than meets the eye, but to no avail.  There’s not one article that appears different than the others, the facts appear to be just that and it’s worse than the hot McDonald’s coffee.  No, I’m not referring to the Sandusky trial, although I may be discussing that one shortly,no…this one is about the lady who, in my opinion, has lost her mind and is suing a former Little League Baseball Player.  Now some of you may say that I’m being harsh and that I wasn’t there to witness the incident so I don’t know exactly what happened, but let’s just pretend I’m Nancy Grace for a minute and therefore, I get to make all the assumptions I want based off the articles I’ve read. 

And by the way, the little leaguer was 11 years old when the incident occurred.

She was a spectator sitting at a picnic table near the bullpen where little league catcher Matthew Miggliaccio was warming up a pitcher.  Matthew threw the ball back to the pitcher and as 11 years will do, accidentally threw it off and hit Elizabeth Lloyd in the face.

This happens.  As a baseball Mom for over ten years now (and not even mentioning my own softball incidents) I can tell you that when you are a spectator at any sport, you assume some risk and it hurts.  Just recently I had a baseball size black and blue mark on the side of my leg from getting hit while standing near a bullpen.  You know what my thoughts were about this incident??  That’s what I get for standing there.  Duh.

But there is no way a child should have to go to court for not being able to control every throw.

She is suing for $150,000 for medical expenses and an undisclosed amount for “pain and suffering”.  Wow.  Wonder how much Matthew receives in allowances every week.

And here’s the kicker…those two cases are not the only two in this situation, nope…her husband is also suing little Matthew.  Yep, he claims loss of “services, society, and consortium” of his wife. 

What’s that mean?

Wikipedia has consortium as, “A consortium is an association of two or more individuals, companies, organizations or governments (or any combination of these entities) with the objective of participating in a common activity or pooling their resources for achieving a common goal.”

Soooo?  What’s that mean?  Matthew ruined the dream that he and he wife would live happily ever after? I don’t understand.

They’ve demanded a jury trial.  Really?  You can DEMAND a jury trial?? Because honestly, I still would like to plead my case about how Colonel Sanders changed a perfectly fine recipe without telling anyone.  I know you did Colonel…admit it or you’re messing with my consortium.

What do ya’ll think about this one?  And yes, before any of you say it…we can’t possibly know what happened unless we were there…I know, we’d like to be as fair to the situation as possible, but this is just a little ol’ blog, go ahead and vent!  :-)

Has this couple lost their freaking minds??
